Terms, Condition and Waiver of Liability

The Working Goddess Retreat

The Facilitator at Villa Waru is present to share knowledge of stretching the body and promoting holistic health for all levels, physical, mental and spiritual. The Participant recognizes that the stretching classes involve physical activity which may at times be strenuous. By attending these classes, the Participant indicates that he/she is physically fit and agrees to take full responsibility for not exceeding personal limits in the practices of stretching or any of the other sessions on this retreat. The Participant agrees to take full responsibility for any injury physical or mental that the Participant might suffer as a consequence of this retreat. It is the Participant’s responsibility to ascertain that there is no medical reason to prevent his/her participation in the described activities. In consideration for the program at Villa Waru, on this retreat the Participant assumes full risk for any injuries which the Participant may incur and waive any person or entity in anyway involved therewith.

LIABILITY

The Working Goddess Retreat has been designed with safety and security in mind. But the presence of water features, other outdoor elements, and jurisdictional considerations require that the retreat organizer, owner and management company expressively disclaim any and all liability for any accidents, death, personal injury, loss or damage to persons or personal belongings however caused and of any nature whatsoever to guests and/or any third parties whilst staying at or visiting with The Working Goddess Retreat. The use of all accommodations and amenities including the pool is entirely at the user’s own risk. Glass or crockery is not permitted within the pool area. Children must be supervised by responsible adults at all times when using the pool. Children under 6 must be accompanied at all times near pool, pond, terrace and stair areas.

The owner and management company does not accept any liability for any loss of rental time due to travel problem, flight delays or cancellations, industrial disputes or any events outside our control, including any form of Force Majeure. The owner and management company does not accept responsibility for the sudden failure of villa equipment but will take reasonable action to rectify any such failure upon notification by the guests.

CONDITIONS OF STAY OR VISIT

Any loss or damage to the property of possessions of any guest, resident or visitor, whether such damage was caused by fire, theft, or otherwise, or by the negligence or the wrongful act of anyone in the employment of, or acting on behalf of the owner. Any personal injuries of whatsoever nature, sustained by a guest, resident or visitor, whether such injuries were sustained by the negligence or wrongful act of anyone employed by the owner or any other person or by the defective functioning of any apparatus or appliance of the owner.

Any person who registered on the retreat and who is accompanied or visited by any other person, or who is to be accompanied by or visited by any other person, safeguard the owner against any responsibility towards any persons in the instances explained in the conditions in the one paragraph above. The retreat accommodation is provided on a cash basis only and that guests, visitors or residents must pay their accounts at the termination of stay, or as otherwise arranged.

INSURANCE

It is recommended that all guests be covered by travel insurance that carries adequate protection against delays and cancellations, and has adequate medical insurance for Indonesia, and for your luggage and personal belongings.

FORCE MAJEUR

As with any other holiday, there maybe circumstances completely beyond our control and contemplation, in which the property might not be available for your booking. Examples of these circumstances include (but are not limited to) destruction of or severe damage to the property. Such circumstances are referred to Force Majeure. In the event of Force Majeure the owners will do their best to make alternative arrangements for you where possible. If they cannot, or if the alternative arrangements are not acceptable to you, then they will refund all monies paid. This will be the full extent of the owner’s liability to you in such circumstances, and they shall not be responsible for any other costs connected with any such cancellation, howsoever arising.

LAW

This conduct is subject to and shall be construed in accordance with the laws of England and all parties hereby submit to the exclusive jurisdiction of the English Courts.

I acknowledge that I have read this Booking Terms and Waiver of Liability carefully and understand its meaning and I am voluntarily releasing above named parties from all liabilities arising out of my stay or visit for The Working Goddess Retreat.

ARRIVALS AND DEPARTURES

The retreat is available for occupancy from 2 pm on the date of arrival and must be vacated by 4 pm on the day of departure. Late check-out must be agreed beforehand.

SMOKING

Due to all the grass roofs, smoking is not permitted in any of the indoor areas. For smoking outdoors, please take extra precaution to use ashtrays and dispose cigarettes safely.
